Scope

These General Terms and Conditions of Sale (GTC) apply to all reservations made with SARL CAP FREDELLE, operator of L'Escale de Varaire and Maison Authentique du Quercy (furnished rental and bed and breakfast).

These terms and conditions govern all direct bookings, including those made through the integrated Elloha booking engine. Bookings made through third-party platforms such as Booking.com, Airbnb, and Cybevasion are governed by the terms and conditions of those intermediaries.

Any booking request constitutes full and unreserved acceptance of these Terms and Conditions. The client acknowledges having the legal capacity to contract (legal majority, absence of guardianship or conservatorship).

These terms and conditions are sent by email with the booking confirmation and are available upon request to contact@lescaledevaraire.fr .


Article 1 — Rates

Prices are expressed in euros, inclusive of all taxes. Only the price shown in the booking confirmation is binding ; prices displayed on promotional materials are subject to change without notice.

The pilgrim rate (upon presentation of the Credential, Créantial or Travel Journal) includes: a bed with fitted sheet, pillowcase and blanket. The tourist tax is charged separately.

Services not mentioned in the confirmation (extras, drinks, additional services) are charged separately during the stay.

Specific fees — House 1765 & Bread Oven Room:

  • House cleaning fee (Maison 1765): €200 for stays > 3 nights / €120 for stays ≤ 3 nights
  • Cleaning of the Bread Oven Room: €15/stay
  • Central heating (oil): €5/day — Wood stove: €3/day (applicable from October 1st to April 30th)
  • Security deposit for Maison 1765 (individual rental): €500 (cash or credit card imprint) — refunded no later than the day after departure
  • Security deposit for group rental (House 1765 + Bread Oven Room + Cottage): €1,000 (cash or check) — refunded no later than the day after the check-out inspection.

Article 2 — Reservations, deposit and payment methods

Reservations can be made through the following channels:

  • Live contact: integrated Elloha motor, phone (+33 6 29 87 30 80 / +33 6 70 52 42 48), email (contact@lescaledevaraire.fr), postal mail, Facebook Messenger
  • Via third-party platforms: Booking.com, Airbnb, Cybevasion (terms and conditions specific to each intermediary)

Direct booking is only firm and final after receipt of the deposit AND written confirmation from the cottage (email or text).

Schedule of advance payments:

  • 50% of the total amount for a one-night stay (overnight stay and/or half-board)
  • Equivalent to 2 nights for a stay of 4 to 7 nights
  • 50% of the total amount for stays of more than 7 nights
  • Group rentals (House 1765 + Bread Oven Room + Cottage): 30% of the total flat rate, according to the terms set out in the specific rental agreement signed between the parties
  • Groups on a special quote basis: amount and terms fixed by written agreement between the parties

Exception for group rentals:For rentals including Maison 1765, the cancellation policy, deposit amount, and balance payment schedule are set out in the specific rental agreement signed by both parties, which takes precedence over these General Terms and Conditions in case of conflict. The balance is due 15 days before the start of the stay (and not on-site) for group rentals.

Legal Nature of the Deposit: The deposit paid upon booking constitutes the first firm and final payment towards the total price of the stay. It represents the irrevocable commitment of both parties and differs fundamentally from a down payment , which allows either party to withdraw from the agreement (the client forfeits the down payment; the service provider pays double). The deposit, however, does not provide for any right of withdrawal: in the event of cancellation by the client, it does not entitle them to an automatic refund, regardless of the date of cancellation. This is why our Terms and Conditions provide, depending on the circumstances, for a credit note or a partial refund upon presentation of supporting documentation—provisions more favorable than those required by law.

⚠ Providing bank card details constitutes authorization to collect deposits and flat-rate fees due in case of cancellation, modification, shortened stay, theft or damage.

Accepted payment methods: credit card (secure link), bank transfer, bank check (cashed upon receipt), PayPal. The balance is settled on site (cash, credit card, PayPal, bank transfer). For long-term stays, the bill is settled weekly.


Article 3 — Modification of a reservation

Any request for modification must be made by email or telephone. It is only effective after written confirmation from the gîte .

  • Pilgrims: free changes up to 48 hours before arrival
  • Hikers staying in dormitories (excluding pilgrims): free changes up to 5 days before arrival
  • Other guests: changes made within 5 days of arrival will incur a €50 surcharge. The length of the new stay cannot be shorter than the originally booked stay.

Rule regarding successive postponements:
Any date postponement accepted by the gîte constitutes a new reservation for the modified date. The initial deposit is transferred to the new date. In the event of a subsequent cancellation, the cancellation conditions (article 5) apply from the date of the accepted postponement. The operator reserves the right to refuse any request for modification.

The customer will not be entitled to any refund or compensation due to a refused modification.


Article 4 — Interruption of stay

If a guest (excluding pilgrims) shortens their stay without informing the guesthouse at least 48 hours before their scheduled departure date, an additional night will be charged as compensation. The guest remains liable for the full cost of the reserved nights in the event of an early departure.


Article 4bis — Customer Insurance

For group rentals including Maison 1765, the tenant agrees to provide proof of Holiday Civil Liability insurance (individuals) or Organizer Civil Liability insurance (associations and groups) covering the entire period of the stay.

This certificate must be sent by email to contact@lescaledevaraire.fr no later than 48 hours before the start of your stay . Otherwise, SARL CAP FREDELLE reserves the right to refuse access to the premises, without any refund being due.

For individual overnight bookings (pilgrims, hikers, holidaymakers), personal civil liability insurance is strongly recommended.


Article 5 — Cancellation Conditions

All cancellations must be notified by email or telephone . They are only firm and final after written confirmation from the gîte . The date of receipt of the request is the date used for the cancellation.

5.1 — Pilgrim clients (direct booking)

Definition of pilgrim status:
Pilgrim status is assessed according to the quality of the traveler , and not according to the type of accommodation booked. Any client undertaking a pilgrimage or a multi-day hike on one of the GR® trails serving Varaire (GR65, GR36, GR46) is considered a pilgrim, as evidenced by the presentation of a Credential, Créantial, or travel journal, or by booking options specifically priced "pilgrim" in the reservation confirmation. This applies regardless of the accommodation type chosen (dormitory, private room, Bread Oven Room, etc.).

Cancellation more than 48 hours before arrival (before 3pm):

  • With valid proof → 50% refund of the deposit received. Balance not due.
  • No proof required → credit note valid for 12 months from date to date. Balance not due.

Cancellation less than 48 hours before arrival or no-show:

  • With or without proof of purchase → deposit retained . Balance of the entire stay invoiced.

Accepted supporting documents:
The supporting document must demonstrate an impediment beyond the client's control , directly related to the inability to attend: medical certificate, hospitalization certificate, death notice of a close relative (with proof of relationship), canceled travel ticket, major damage to the primary residence (fire, destruction). L'Escale de Varaire has sole discretion to determine the validity of the supporting document provided.
A voluntary reorganization of the itinerary or a change of personal plans does not constitute grounds for a refund.

5.2 — Non-pilgrim clients (hikers, holidaymakers — direct booking)

Cancellation more than 5 days before arrival:

  • With valid proof of purchase → deposit refunded . Balance not due.
  • No proof required → credit note valid for 12 months from date to date. Balance not due.

Cancellation less than 5 days before arrival or no-show:

  • With or without proof of purchase → deposit retained . Balance of the entire stay invoiced.

5.3 — Bookings via Booking.com (non-refundable offers)

For non-refundable offers booked through Booking.com, the full amount of the stay is charged at the time of booking. These stays are non-cancellable, non-refundable, non-modifiable, and non-exchangeable (no changes to dates, duration, or number of participants).

5.4 — Group rentals (House 1765 + Bread Oven Room + Cottage)

The cancellation conditions applicable to group rentals are governed by a specific rental agreement signed between the parties, which takes precedence over these General Terms and Conditions. This agreement notably includes a progressive cancellation scale (0% / 30% / 50% / 100% depending on the notice period), a specific clause for associations, and the conditions for termination in cases of force majeure.

In the absence of a specific contract signed, the cancellation conditions for non-pilgrim clients (article 5.2) apply by default.


Article 6 — Right of withdrawal

In accordance with Article L221-28 12° of the French Consumer Code , tourist accommodation services booked for a specific date or period are not subject to the 14-day right of withdrawal . Acceptance of the booking and payment of the deposit constitutes a firm and final commitment.


Article 7 — Force majeure

In the event of exceptional circumstances or force majeure making it impossible to accommodate clients, CAP FREDELLE SARL will endeavor to offer alternative accommodation of an equivalent category at its own expense. If no solution can be found, all sums paid will be fully refunded. No further compensation may be claimed by either party.


Article 8 — Complaints and Mediation

Any complaint must be addressed to SARL CAP FREDELLE within 15 days of the date of stay , by email to contact@lescaledevaraire.fr or by post.

If a satisfactory response is not received within 60 days , the customer may contact the Tourism and Travel Mediator (MTV) free of charge: www.mtv.travel

All disputes are subject to French law and the exclusive jurisdiction of the French courts .


Article 9 — Protection of personal data

In accordance with Law No. 78-17 of 6 January 1978 (Data Protection Act) and the GDPRCustomer personal data is processed electronically for the purpose of managing reservations. This data is not shared with third parties.

Article 10 — Use of the Wi-Fi network

The Wi-Fi access provided is reserved for personal and lawful use. The customer agrees not to use it for the purpose of reproducing or making available works protected by copyright without the authorization of the rights holders, in accordance with Books I and II of the Intellectual Property Code.


Article 11 — Applicable Law

These Terms and Conditions are governed by French law , both substantively and procedurally. Any dispute shall be subject to the exclusive jurisdiction of the French courts .
